1. This User Agreement governs your relationship with SeePaws and your use of and access to all services and products provided by SeePaws (collectively, the Services). You agree that by accessing or using any part of the Services you are bound by the terms of this User Agreement (the Terms), including the applicable Privacy Policy and Community Guidelines incorporated herein. 
   We don’t charge you to use SeePaws or the other products and services covered by these Terms. Instead, businesses and organizations pay us to show you ads for their products and services. By using our Products, you agree that we can show you ads that we think will be relevant to you and your interests. We use your personal data to help determine which ads to show you.
   
   We don’t sell your personal data to advertisers, and we don’t share information that directly identifies you (such as your name, email address or other contact information) with advertisers unless you give us specific permission. Instead, advertisers can tell us things like the kind of audience they want to see their ads, and we show those ads to people who may be interested. We provide advertisers with reports about the performance of their ads that help them understand how people are interacting with their content.
2. You may not use the Services unless all of the following apply to you, and you affirm that all of the following apply to you:
   2.1 You are at least 13 years old;
   2.2 You are either an adult over the age of 18 years old, an emancipated minor, or you have express permission from your parent or legal guardian to use the Services;
   2.3 You are legally allowed to use the Services where you live;
   2.4 You are not using the Services or accepting the Terms on behalf of any other entity, such as a company or organization, unless you have authority to bind that entity to these Terms;
   2.5 You have not been banned by SeePaws from using the Services. 
3. The SeePaws Privacy Policy describes what SeePaws can do with information about you received by SeePaws when you use the Services. You agree to the terms of the Privacy Policy. 
4. Any content that you post to the Services must satisfy all of the following criteria, and you affirm that any content posted, submitted, or otherwise provided by you to the Services satisfies these criteria:
   4.1 You have the legal right to post the content to the Services.
   4.2 The content and the purpose for posting it complies with all laws, rules, and regulations that may apply.
   4.3 The content does not infringe the intellectual property rights (such as copyrights and trademark rights) of any other person or entity.
   4.4 The content does not include non-public personal private information belonging to someone else, such as another person’s birthdate, home address, or telephone number.
   4.5 The content complies with the SeePaws Community Guidelines. You are responsible for your use of the Services and for any content that you post. SeePaws does not endorse, support, represent, or affirm the completeness, truthfulness, accuracy, or reliability of any of the content posted through the Services. All content is the sole responsibility of the person who originated the content, and SeePaws does not take responsibility for such content.
   4.6 With respect to any content you contribute that uses YouTube services via SeePaws, you affirm that—in addition to complying with SeePaws’ own Terms and Community Guidelines—you are also complying with YouTube’s more restrictive Terms. (Users are encouraged to use SeePaws’ own native video capabilities whenever they wish to avoid the application of these more restrictive terms.) 
5. You grant to SeePaws a license to any content posted by you to the Services, including a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute your content. You agree that SeePaws or its service providers or partners may display advertising in connection with your content and otherwise monetize your content without compensation to you. You warrant that you have all rights necessary to grant these rights to SeePaws and SeePaws users. You also grant a limited non-exclusive, royalty-free license to any user of the Services to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute any content posted by you to the Services solely in connection with that users use of the Services. The licenses granted by you hereunder do not include any moral rights or right of attribution. 67. Copyright infringement is not allowed on the Services, and SeePaws will, in appropriate circumstances, terminate the account of any repeat infringer. If your copyright has been infringed by any content on the Services and you did not grant a license for this use by uploading your copyrighted work to the Services, you may submit a notice that meets all of the requirements of the Digital Millennium Copyright Act (DMCA), 17 U.S.C 512(c)(3), to our Copyright Manager at abuse@seepaws.com. Your notice must include: (1) electronic or physical signature of the copyrighted work owner (or person authorized by the copyright owner), (2) a description of the copyrighted work, including the URL where the infringing content is available, or a copy of it, (3) contact details of the person submitting the notice, including email address, telephone, and mailing address, (4) statement in “good faith belief” that the work is not authorized by the copyright owner, and (5) a statement by the sender that all of the above information is accurate, and that the person sending the notice is either the copyright owner or is authorized to act on behalf of the copyright owner. Upon receiving a notice satisfying these requirements, SeePaws will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the services. 
6. You may not interfere with the Services in any way, such as by accessing the Services through automated means in a manner that puts excessive demand on the Services; by hacking the Services; by accessing without authorization areas of the Services that are protected by technical measures designed to prevent unauthorized access; by testing the vulnerability of the Services; by impersonating SeePaws or the Services; by accessing the Services for any purpose that competes with the interests of SeePaws; by spamming the users of the Services; by failing to respond to operational communications or requests from SeePaws; or through any other type of interference with the Services or SeePaws’ relationships with others. 
7. SeePaws may remove any content and terminate your access to the Services at any time and for any reason to the extent SeePaws reasonably believes (a) you have violated these Terms or SeePaws’ Community Guidelines, (b) you create risk or possible legal exposure for SeePaws, or (c) you are otherwise engaging in unlawful conduct. Any invitation made by SeePaws to you to use the Services or submit content to the Services, or the fact that SeePaws may receive a benefit from your use of the Services or provision of content to the Services, will not obligate SeePaws to maintain any content or maintain your access to the Services. SeePaws will have no liability to you for removing any content, for terminating your access to the Services, or for modifying or terminating the Services. 
8. You agree to receive communications from SeePaws, including communications sent by phone, email, text message, or other means of communication. If you provided a phone number to SeePaws, you are required to notify SeePaws when you cease to own or control that number to help prevent SeePaws from sending communications to others who may acquire that number. 
9. The Services are provided to you as-is and at your own risk. The Services come with no express or implied warranties, except those that cannot be disclaimed under the law. SEEPAWS DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES AND CONDITIONS, SUCH AS MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SeePaws makes no representation or endorsement about the function of the Services or any content available through the Services. SeePaws has no responsibility or liability to you arising from your use of the Services. SeePaws has no responsibility or liability to you arising from content provided by you or any other person, even if such content is untrue, harmful, damaging, offensive, inappropriate, fraudulent, tortious, unlawful, contrary to social norms, etc. Although SeePaws may make efforts to review or monitor content, you agree that you will not rely on this fact for any purpose. SeePaws has no responsibility or liability to you arising from hacking event, data breach, theft, misuse of information, conspiracy, racket, fraud, act of terrorism, misappropriation of information, technical malfunction, interruption of service, or similar event that may cause you to suffer damage, loss, or injury, including without limitation any damage to or loss of your personal property, data, operations, information, reputation, goodwill, profits, etc. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND REGARDLESS OF THE NATURE OF THE CAUSE OF ACTION, SEEPAWS WILL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR FOR INTANGIBLE LOSSES, ARISING FROM (a) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES; (b) FROM THE ACTS OR OMISSIONS OF ANY OTHER PERSON OR THIRD PARTY, INCLUDING, WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER PERSONS OR THIRD PARTIES; (c) ANY CONTENT OBTAINED FROM THE SERVICES; OR (d) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR COMMUNICATIONS THROUGH THE SERVICES. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF SEEPAWS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF TWO HUNDRED U.S. DOLLARS (U.S. $200.00) OR THE AMOUNT YOU PAID SEEPAWS, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM. THE LIMITATIONS OF THIS SECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND SHALL FURTHER APPLY WHETHER OR NOT SEEPAWS HAS BEEN INFORMED OF THE POSSIBLITY OF ANY SUCH DAMAGES AND EVEN IF A REMEDY LAID OUT IN THESE TERMS IS FOUND TO HAVE FAILED ITS ESSENTIAL PURPOSE. 
10. Applicable law and jurisdiction. The laws of the State of Michigan, excluding its choice of law provisions, will govern these Terms and any dispute that arises between you and SeePaws. All disputes related to these Terms or the Services will be brought solely in the state or federal courts located in Emmet County, Michigan, United States, and you consent to personal jurisdiction and waive any objection as to inconvenient forum. 
11. You affirm that you are competent to agree to be bound by this User Agreement, meaning that you are over the age of 18, an emancipated minor, or have legal parental or guardian consent. Parents of minors should be aware that, in addition to the NSFW filters made available by SeePaws, there are a number of Parental Control products and features available on the market, which can help you tailor your child’s experience on our platform.
12. SeePaws cannot waive any right to enforce this User Agreement, unless it does so expressly in writing. No waiver of any part of this User Agreement, will be a further or continuing waiver of that part or any other part, and no failure to enforce any part of his User Agreement will be deemed a waiver of any kind. 
13. SeePaws may modify the Terms of this User Agreement in any way and at any time without notice to you, and you agree to be responsible for making yourself aware of any modification of the Terms and to be bound by any modification of the Terms when you continue to access or use the Services after any such modification. As a matter of courtesy, SeePaws endeavors to inform its users of any such changes. These Terms supersede all prior agreements between you and SeePaws pertaining to the Services. Except for the statements in this document and the documents expressly incorporated herein by reference, no statement by SeePaws or anyone associated with SeePaws, whether verbal or written, can modify or supplement the Terms of this User Agreement unless the modification or supplement is stated expressly in writing by referring to this User Agreement. If any of the Terms in the User Agreement are held to be invalid or unenforceable by a court or arbitrator or by operation of law, the remaining Terms will remain in effect. Privacy Policy

SeePaws LLC and its affiliates (“Company,” “we,” “our,” and/or “us”) value the privacy of individuals who use our social application, website, and related services (collectively, our “Services”).
This privacy policy (the “Privacy Policy”) explains how we collect, use, and share information from users of our Services (“Users,” “you,” and/or “your”). By using our Services, you agree to the collection, use, disclosure, and procedures this Privacy Policy describes. Beyond the Privacy Policy, your use of our Services is also subject to our User Agreement. 

Information We Collect

We may collect a variety of information from or about you or your devices from various sources, as described below.

Information You Provide to Us.

• Registration and Profile Information. When you sign up for an account, we may collect information such as your name, email address, username, and profile photo.
• User Content. We collect any information you choose to provide on our Services, such as posts, photos, videos, gifs, comments, messages, votes, and shares. This can include information in or about the content you provide (like metadata), such as the location of a photo or the date a file was created.
• Payment Information. If you make a purchase through our Services, your payment-related information, such as your credit and debit card or automated clearing house (ACH) information, is collected and stored by our third-party payment processor on our behalf. This includes payment information, such as your credit or debit card number and other card information; other account and authentication information; and billing, shipping and contact details.
• Communications. If you contact us directly, we may receive additional information about you. For example, if you contact us for customer support, we may receive your name, email address, phone number, the contents of any message or attachments you may send to us, and any other information you choose to provide.

Information We Collect When You Use Our Services.

• Location Information. When you use our Services, we infer your general location information, for example by using your internet protocol (IP) address.
• Device Information. We receive information about the device and software you use to access our Services, including IP address, device type, web browser type, operating system version, phone carrier and manufacturer, user agents, application installations, device identifiers, mobile advertising identifiers, and push notification tokens. We collect information from and about the computers, phones, connected TVs and other web-connected devices you use that integrate with our Products, and we combine this information across different devices you use. For example, we use information collected about your use of our Products on your phone to better personalize the content (including ads) or features you see when you use our Products on another device, such as your laptop or tablet, or to measure whether you took an action in response to an ad we showed you on your phone on a different device.
• Usage Information. To help us understand how you use our Services and to help us improve them, we automatically receive information about your interactions with our Services, such as the posts or other content you view, the searches you conduct, the people you follow, and the dates and times of your visits.
• Networks and connections. We collect information about the people, Pages, accounts, hashtags and groups you are connected to and how you interact with them across our Products, such as people you communicate with the most or groups you are part of.
• Your Contacts. If you permit us to access the address book on your device or give us permission to import your contacts from an email account associated with your account, we may access and store names and contact information from your address book to facilitate invitations and social interactions that you initiate through our Services and for other purposes described in this Privacy Policy or at the time of consent or collection.
• Things others do and information they provide about you. We also receive and analyze content, communications and information that other people provide when they use our Products. This can include information about you, such as when others share or comment on a photo of you, send a message to you, or upload, sync or import your contact information.
• Information from Cookies and Similar Technologies. We and our third-party partners, such as analytics partners, collect information using cookies, pixel tags, and similar technologies. Cookies are small text files containing a string of alphanumeric characters. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to our Services.
  
  Please review your web browser’s “Help” file to learn the proper way to modify your cookie settings. Please note that if you delete or choose not to accept cookies from our Services, you may not be able to utilize the features of our Services to their fullest potential.

How We Use the Information We Collect

We may use the information we collect:

• To provide, maintain, and improve our Services;
• To personalize your experience on our Services, such as by providing tailored content and recommendations;
• To understand and analyze how you use our Services and develop new products, services, features, and/or functionality;
• To communicate with you, provide you with updates and other information relating to our Services, provide information that you request, respond to comments and questions, and otherwise provide customer support;
• For marketing and advertising purposes, such as developing and providing promotional and advertising materials that may be relevant, valuable or otherwise of interest to you;
• To send you text messages and push notifications;
• To facilitate transactions, redemptions, and payments;

• For compliance purposes, including enforcing our User Agreement or other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency; and
• For other purposes for which we provide specific notice at the time the information is collected.

How We Share the Information We Collect

• Vendors and Service Providers. We may share any information we receive with vendors and service providers retained in connection with the provision of our Services.
• User Content. Our Services are social services that allow you to find, enjoy, and share content. Your display name, username, profile photo, about me section, and contacts (i.e., followers and following) will always be viewable and/or searchable by other Users. The content you post to our Services will be displayed on our Services and viewable by other Users by default. Although this content is public by default, in the “Your Choices” section below, we describe the account settings and controls you can use to limit the sharing of certain information. We are not responsible for other Users’ use of available information, so you should carefully consider whether and what to post and how you identify yourself on our Services.
• Marketing. We do not rent, sell, or share information about you with nonaffiliated third parties for their direct marketing purposes unless we have your affirmative express consent.
• Analytics Partners. We use may use 3rd party analytics services to collect and process certain application analytics data.
• As Required By Law and Similar Disclosures. We may access, preserve, and disclose your information if we believe doing so is required or appropriate to: (a) comply with law enforcement requests and legal process, such as a court order or subpoena; (b) respond to your requests; or (c) protect your, our, or others’ rights, property, or safety. For the avoidance of doubt, the disclosure of your information may occur if you post any objectionable content on or through our Services.
• Merger, Sale, or Other Asset Transfers. We may transfer your information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our assets. The use of your information following any of these events will be governed by the provisions of this Privacy Policy in effect at the time the applicable information was collected.
• Consent. We may also disclose your information with your permission.

Your Choices

• Sharing Preferences. We provide you with settings to allow you to set your sharing preferences for content you post to our Services. Certain information, such as your username, may always be publicly available to others, and other information is made publicly available to others by default. To change whether certain information is publicly viewable, you can adjust the settings in your account.
• Marketing Communications. We send you marketing communications consistent with your choices. You can unsubscribe from our promotional emails by adjusting your account settings or via the link provided in the emails. Even if you opt-out of receiving promotional messages from us, you will continue to receive administrative messages from us.
• Notifications. You can opt-out of receiving notifications for posts, votes, shares, comments, and followers by adjusting your profile and/or operating system (i.e., iOS or Android) settings.

Third Parties

Our Services may contain links to other websites, products, or services that we do not own or operate. We are not responsible for the privacy practices of these third parties. Please be aware that this Privacy Policy does not apply to your activities on these third party services or any information you disclose to these third parties. We encourage you to read their privacy policies before providing any information to them.

For example, any information you share with Google as a consequence of sharing or interacting with YouTube content on SeePaws is governed by Google’s privacy policy. Google now provides users some control over the collection of data by its users and API Clients like SeePaws. Exercising such control may require having a Google account, which itself may be a privacy concern for some of our users. Therefore, users are encouraged to use SeePaws’ own native video capabilities (or the capabilities of other platforms equally respectful of user privacy) if they wish to avoid sharing data with Google.

Security

We make reasonable efforts to protect your information by using physical and electronic safeguards designed to improve the security of the information we maintain. However, as our Services are hosted electronically, we can make no guarantees as to the security or privacy of your information.

Protection of Social Security Numbers

We will use safeguards necessary and appropriate to protect the confidentiality of, and preclude unauthorized access to and disclosure of, Social Security numbers. Access to Social Security numbers will be limited to those employees authorized to access that information to perform their legitimate duties. Any documents or other records containing Social Security numbers will be destroyed in a secure manner.

Children

We do not knowingly collect, maintain, or use personal information from children under 13 years of age, and no part of our Services is directed to children. If you learn that a child has provided us with personal information in violation of this Privacy Policy, then you may alert us at support@seepaws.com.

International Transfers of Data

Our Services are hosted in the United States. If you choose to use our Services from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the United States for storage and processing. By providing any information, including personal information, on or to our Services, you consent to such transfer, storage, and processing.

Update Your Information or Pose a Question

You can update your account and profile information, or delete your account, through your account settings. If you have questions about your privacy on the Services or this privacy policy, please contact us at support@seepaws.com.

Changes to the Privacy Policy

We will post any adjustments to the Privacy Policy on this page, and the revised version will be effective when it is posted. If we materially change the ways in which we use or share personal information previously collected from you through our Services, we will notify you through our Services, by email, or other communication.
